Terms of Use

These Terms govern access to and use of Kintsugi, including its digital ceramic restoration experiences, augmented-reality views, collection features, digital content, CloudKit services and Community features.

Using Kintsugi

These Terms of Use (the “Terms”) govern access to and use of Kintsugi, including its digital ceramic restoration experiences, augmented-reality views, collection features, digital content, CloudKit services and Community features (together, the “Service”). By downloading, installing or using Kintsugi, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.

For notices concerning Community content, intellectual property, privacy or security, email this address and include “Kintsugi” in the subject line. Notices about a publication should include, where possible, the piece link or identifier and the reason for the request.

2. Relationship with Apple

Kintsugi is distributed through the Apple App Store. Unless a separate custom end-user license agreement is expressly provided, your license to the app is also subject to Apple’s Standard Licensed Application End User License Agreement and Apple’s Usage Rules.

These Terms are an agreement between you and the Kintsugi provider, not between you and Apple. The provider, not Apple, is responsible for Kintsugi, its content and claims relating to the app. Apple and its affiliates are third-party beneficiaries of these Terms and may enforce them where applicable. Apple has no obligation to provide support, maintenance or warranty services for Kintsugi, without limiting any rights you may have under applicable law.

3. What Kintsugi provides

Kintsugi is a creative and contemplative experience for creating and restoring digital ceramic pieces. It may include:

  • local projects with forms, materials, pigments, brushes, bands, finishes, environments and procedural or authored fracture systems;
  • augmented-reality scenes and captures using the device camera and spatial tracking;
  • viewing, saving and deleting projects and previews;
  • optional synchronization through iCloud/CloudKit when the system, iCloud account and product configuration allow it;
  • Community features for creating a public profile, submitting captures, browsing published pieces, liking content, reporting content and blocking authors; and
  • additional digital content offered through in-app purchases.

Features, models, materials, content, device compatibility and Community availability may change. A submission to Community may remain pending, may not be published, or may be removed after publication.

4. Age, device and responsible use

Kintsugi is a general-audience creative app and is not designed or marketed specifically for children. Use of the Service must comply with the age requirements and parental-consent rules that apply to you and in your jurisdiction. Do not use the app if you cannot legally accept these Terms.

You are responsible for having a compatible device, compatible operating-system version, an internet connection where required and an Apple/iCloud account when an Apple feature requires one. Camera and augmented-reality use require attention to your surroundings: do not use Kintsugi while driving, walking in a hazardous area or doing anything that requires your full attention. Keep your device safe and follow system instructions.

The visual experiences are not measurements of the physical world and do not replace your own judgment. The provider does not guarantee that scale, position, lighting or tracking in an AR scene will be accurate on every device or in every condition.

5. Your projects and captures

You retain your rights in the names, notes and captures you create, provided that you have the necessary rights in any material they contain. You are responsible for keeping a copy of anything you want to preserve. Uninstalling the app, changing your iCloud account, a device failure, a synchronization issue or lack of storage may make a project or preview unavailable.

When you export or share an image outside Kintsugi, you are responsible for where you send it and for checking that it does not contain information, people, works or places that you are not authorized to disclose.

6. Community

Community is optional. To publish, you may need an available iCloud account and must create a profile with a public identifier (“handle”) and, optionally, a visible display name. Submitted captures are processed to fit the publication format and may be displayed publicly with that profile, the publication date and interaction metrics.

When you submit a capture to Community, you confirm that:

  1. you own or have sufficient permission to submit, reproduce and display the content;
  2. the capture does not include personal data, faces, children, third-party works, trademarks, text or other material whose public use is unauthorized;
  3. the information you provide is truthful and does not impersonate another person; and
  4. the content complies with these Terms and the Community Rules.

You grant the provider a worldwide, non-exclusive, royalty-free license, limited to the period during which the content is available, to host, process, technically adapt, reproduce, display and distribute your submission within Kintsugi, Community, its pages and communications related to the Service. This license does not transfer ownership of your content and does not allow the provider to sell it as an independent work. The license ends for future uses when the content is deleted, except for technical copies, security records, legal obligations or evidence reasonably needed to address abuse and claims.

The provider may filter, delay, reject, hide, limit, remove or de-index content; block authors; suspend features; or close a profile where necessary to comply with law, these Terms, the Community Rules or Apple policies, or to protect users and the Service. Moderation may combine automated filters, reports and human review. We do not guarantee that every unlawful or offensive item will be detected immediately.

You can report a piece from within the app. You may also email contact@joeblacksmith.com. Reports are handled reasonably and proportionately; we will not disclose the reporter’s identity unless required by law or reasonably necessary to manage the case.

You can delete your Community profile and associated data from the in-app account controls. You can also request removal of an individual publication from your profile. Deletion may not remove technical copies, security records, reports, fraud-prevention records or data that must be retained by law.

7. Prohibited conduct

You may not use the Service to:

  • publish pornography, sexual exploitation, threats, harassment, hate, graphic violence, self-harm content, criminal activity or dangerous instructions;
  • defame, intimidate, discriminate against, impersonate, stalk or expose the personal data of another person without a lawful basis;
  • infringe copyright, trademarks, designs, privacy, publicity or any other third-party rights;
  • send spam, fraud, malware, unauthorized advertising or malicious links;
  • manipulate likes, rankings, publications or moderation processes;
  • attempt to access data, accounts, records or features that are not yours, or bypass security, purchase or access controls;
  • scrape content at scale, train systems on it, resell it or create a substitute service without authorization; or
  • use the Service in breach of law or Apple’s rules.

8. Digital content purchases

Kintsugi may offer collections, finishes or other additional digital content as one-time in-app purchases. The product, scope, price, taxes, currency and availability will be shown before you confirm a purchase. The current catalog does not offer an auto-renewable subscription; if a subscription is offered in the future, its price, duration, renewal and cancellation terms will be shown clearly before purchase.

Payment is charged to your Apple ID through the App Store/StoreKit. The provider does not receive your full payment-card details. Purchases are subject to Apple’s terms, the account used for purchase and technical content availability. You may use the restore-purchases function where available. Refund requests must be submitted to Apple through its support channels and are subject to Apple’s policies and your statutory rights.

An indication of interest in a possible future physical edition is not a purchase, reservation, order or promise to manufacture. The response and any optional email are used only to evaluate that possibility; there is no obligation to produce or sell the edition at the indicative price shown.

9. Kintsugi intellectual property

Kintsugi, its code, architecture, brand, design, text, models, materials, scenes, sounds, interfaces and content supplied by the provider or its licensors are protected by intellectual-property rights. You receive only a personal, limited, non-exclusive, non-transferable and revocable license to use the app under these Terms and the applicable Apple EULA.

You do not acquire ownership of the app or its resources by installing, using or purchasing access to digital content. You may not copy, redistribute, modify, decompile, disassemble, reverse engineer or create derivative works from the app, except where applicable law does not permit that restriction or an open-source license authorizes it.

10. Third-party services

Kintsugi partly depends on Apple services, including the App Store, StoreKit, iCloud, CloudKit, ARKit and system services. Those services have their own terms, permissions, limits, outages and privacy policies. Lack of an iCloud account, a network issue or a system restriction may prevent publishing, synchronization or content loading.

11. Availability, warranties and liability

The provider works to keep Kintsugi available but does not guarantee that the Service will be continuous, secure, error-free, compatible with every device or fit for a particular purpose. Beta, experimental or server-dependent features may change or disappear.

To the fullest extent permitted by law, the Service is provided “as is” and “as available”. Nothing in these Terms limits statutory warranties, consumer rights, liability for fraud, willful misconduct, gross negligence, personal injury or any other right that cannot lawfully be excluded or limited.

To the extent permitted by law, the provider will not be liable for indirect, incidental, special or consequential damages, loss of opportunities, loss of data caused by failing to keep a copy, device incompatibility or outages of Apple services. This limitation does not apply where the law prohibits that exclusion or limitation.

12. Suspension and termination

You may stop using Kintsugi at any time. The provider may suspend or limit your access, a publication or a feature for reasonable grounds relating to safety, fraud, abuse, breach of these Terms, legal obligations or Apple requirements. Where reasonable, we will notify you and you may contact us to request a review.

Termination does not automatically remove obligations that by their nature must continue, including intellectual property, content licenses, liability, outstanding claims and legally required record retention.

13. Changes to these Terms

We may update these Terms to reflect changes to the Service, the law or platform rules. We will publish the updated version and change the effective date. If the change is material, we will provide reasonable notice where possible. If you continue using Kintsugi after the effective date, you accept the updated Terms; if you do not accept them, stop using the Service.

14. Governing law and mandatory rights

These Terms are interpreted under the law applicable to the provider, without prejudice to mandatory consumer-protection, privacy, intellectual-property and jurisdiction rules that protect you in your place of residence. If a provision is held invalid, the remaining provisions remain effective.
